Las denuncias por responsabilidad médica en Ecuador se incrementaron en la última década a raíz de la penalización de la mala práctica profesional establecida en el Código Orgánico Integral Penal; la investigación es compleja y el peritaje médico legal se convierte en una pieza fundamental en el conflicto. Aquí analizamos 10 informes periciales de casos de mala práctica médica en Ecuador, se analiza la legislación ecuatoriana y revisión de la literatura referente al tema. Se identificó la falta de protocolos o (...) guías de procedimientos, los informes no cuentan con estructura y es el resultado de la discrecionalidad del perito designado. Se propone un protocolo de actuación pericial que facilitará la actividad del perito y mayor objetividad en la investigación. (shrink)

Resumen El análisis del poema Caperucita Roja resulta atractivo por sí mismo, ya que su factura corrobora las cualidades inigualables de la poeta Gabriela Mistral. Sin embargo, el hecho de que sea reescritura de un cuento que remonta sus orígenes al folklore europeo y que sea mundialmente conocido por medio de sus versiones modernas desde un punto de vista infantil: Perrault y los hermanos Grimm, vuelve la obra una curiosidad. El propósito del análisis es describir la dimensión erótica del sistema (...) de recursos lingüístico-discursivos usados por Mistral para recrear la historia y refundar el sentido del texto original, quizá recuperando la lectura del crimen, la inocencia ultrajada y el dolor que aquel ofrecía. Abstract The analysis of Gabriela Mistral´s poem Little Red Riding Hood is appealing since its composition confirms the insuperable quality of the author´s poetic work. However, the fact that the story finds its origins in the European folklore and that it became known worldwide due to its modern versions (Perrault and the Brothers Grimm), turn the poem into a curiosity. The purpose of the analysis is to describe of the erotic dimension of the linguistic discursive resources used by Mistral to recreate the story and restore the meaning of the original text, probably recovering its reading as crime, shattered innocence, and the pain that it conveyed. Long noncoding RNAs have been described in cell lines and various whole tissues, but lncRNA analysis of development in vivo is limited. Here, we comprehensively analyze lncRNA expression for the adult mouse subventricular zone neural stem cell lineage. We utilize complementary genome-wide techniques including RNA-seq, RNA CaptureSeq, and ChIP-seq to associate specific lncRNAs with neural cell types, developmental processes, and human disease states. By integrating data from chromatin state maps, custom microarrays, and FACS purification of the subventricular zone lineage, we (...) stringently identify lncRNAs with potential roles in adult neurogenesis. shRNA-mediated knockdown of two such lncRNAs, Six3os and Dlx1as, indicate roles for lncRNAs in the glial-neuronal lineage specification of multipotent adult stem cells. El estudio propuesto intenta ofrecer una entrada parcial pero ilustrativa del fenómeno de canonización de la figura autorial de Roberto Bolaño y su obra, desde una perspectiva sistémica, valorativa y diacrónica. El supuesto básico de este trabajo es que la lengua es un sistema social y una red de recursos de construcción de significado que se instancia a través de múltiples textos, surgidos según condiciones contextuales determinadas, orientados a la consecución de metas específicas y constreñidos por valores y reglas institucionales (...) que determinan su funcionamiento, orientación, circulación y predominancia. Se utiliza el enfoque lingüístico sistémico-funcional como marco teórico y se recurre a algunas de sus herramientas analíticas para explicar los significados interpersonales cristalizados en un texto crítico literario que sirve de ejemplo del tipo de discursos integrantes del proceso dinámico y conflictivo de formación de cánones literarios. El análisis demuestra que el texto presenta un compromiso mayoritariamente heteroglósico, pero realizado a través de uno de sus mecanismos menos explícitos y democráticos: la legislación. (shrink)

The aim of the present study is to analyze individual differences in academic self-efficacy within a population of Unaccompanied Foreign Minors from the European cities of Ceuta and Melilla. Variables describing educational level and length of stay were considered in a sample of 377 individuals being cared for in different youth centers. Of these, 63.4% belonged to the group who had stayed at the center for less than 9 months and 36.6% reported a length of stay of more than 9 (...) months. The age of participants ranged between 8 and 17 years old. Once the quality parameters of the instrument were elaborated, reliability and validity was confirmed through Confirmatory Factor Analysis using Structural Equation Modeling methodology. Data collection was then initiated. The results overall indicate that 87.6% of those who completed the questionnaire reported a higher level of self-efficacy with regards to working with any classmate, whilst at the same time seeing themselves as capable of achieving good marks. ANOVA results indicated significant differences with respect to educational level and length of stay. In this regard, students who had received professional training and had been at the Center for more than 9 months, were the ones who developed greater academic self-efficacy for spending more time working when tasks were judged to be difficult. The results obtained demonstrate that any intervention will be positive as long as it promotes different institutions to develop strategies that cater to a length of stay of more than 9 months and target education, academic self-efficacy, socialization and strengthening the future workforce. Such interventions can be directed through new European, Spanish or local level policies. It is clear that institutions still have a lot of work left to do. (shrink)

Job motivation remains an area of concern among researchers due to the rising issues of poor or lack of motivation among workers. This refers to one’s personal will or drives to perform a task at work. Meanwhile, job satisfaction refers to an employee’s sense of fulfillment with his or her work experience. Therefore, the current study utilized the descriptive- correlational research design to investigate the impact of job motivation on the job satisfaction of accountants. To gather essential data and achieve (...) the objectives of the study, Multidimensional Work Motivational Scale (MWMS) and Minnesota Satisfaction Questionnaire (MSQ) were administered to the target respondents. The collected data were then analyzed using a Multiple Regression Analysis; findings revealed that job motivation has a significant impact on the job satisfaction of accountants. Additionally, the results of this study were carefully evaluated and discussed, and recommendations were made to benefit the stakeholders of the study and contribute to the existing body of knowledge. Dos místicos relativamente contemporáneos: Etty Hillesum y Benjamín González Buelta; dos estilos, dos contextos y una coincidencia establecida desde sus experiencias espirituales, en profunda conexión con la realidad, en medio de la vida y sus desafíos. Hillesum no habla propiamente de la experiencia mística, sin embargo, su proceso personal existencial en el duro contexto de guerra que le tocó vivir, la condujo a descubrirse profundamente habitada. Su experiencia de Dios le hizo posible comprender y gestionar el dolor en medio de (...) la guerra, así como la necesidad de ‘hacerse bálsamo sobre las heridas’ de sus hermanos judíos. Etty es una mística de ojos abiertos. Benjamín González Buelta ha profundizado en la comprensión de la mística, describiéndola y analizándola desde la experiencia de Dios en el contexto latinoamericano. Su reflexión permite hoy leer a Etty Hillesum desde la perspectiva del místico de ojos abiertos. (shrink)

Although stakeholder theory is widely accepted in environmental disclosure research, empirical evidence about the role of stakeholders in firms’ disclosure is still scarce. The authors address this issue for a setting of carbon disclosure. Our international sample comprises the Carbon Disclosure Project Global 500, S&P 500, and FTSE 350 reports from 2008 to 2011, resulting in a total of 1,120 firms with 3,631 firm-year observations. The authors apply Tobit regressions to analyze the relationship between carbon disclosure and the relevance of (...) the following stakeholder groups: government, general public, media, employees, and customers. Our results confirm that in addition to carbon performance, all stakeholders are associated with carbon disclosure. Only one stakeholder group acts as a moderator for the relationship between carbon performance and carbon disclosure. Furthermore, the authors find that carbon performance but not the affiliation to a carbon-intensive industry acts as a moderator between stakeholder relevance and carbon disclosure. (shrink)

Michael Walzer’s article ‘Political action: the problem of dirty hands’ initiated a new wave of discussion over a persistent problem in moral philosophy: are there situations in which ethical rules must be relaxed so as to bring about a greater good? In this article, we consider whether this ‘dirty hands’ approach may be applied to our current climate crisis. One proposed solution to the problem of global warming is the administration of moral enhancements to the population. Assuming that the administration (...) of moral enhancements is a necessary condition in the prevention of a climate crisis, Parker Crutchfield argues that this procedure ought to be covert. This implies lying to the public, and such dishonesty amounts to immoral behavior. We conclude that despite the severity of global warming, there is no justification for a dirty hands approach. Lying to the public in order to save the planet would probably create bigger problems, and it would ultimately be very counterproductive in trying to save the planet. (shrink)

While some countries are moving toward legalization, euthanasia is still criticized on various fronts. Most importantly, it is considered a violation of the medical ethics principle of non-maleficence, because it actively seeks a patient’s death. But, medical ethicists should consider an ethical alternative to euthanasia. In this article, we defend cryocide as one such alternative. Under this procedure, with the consent of terminally-ill patients, their clinical death is induced, in order to prevent the further advance of their brain’s deterioration. Their (...) body is then cryogenically preserved, in the hope that in the future, there will be a technology to reanimate it. This prospect is ethically distinct from euthanasia if a different criterion of death is assumed. In the information-theoretic criterion of death, a person is not considered dead when brain and cardiopulmonary functions cease, but rather, when information constituting psychology and memory is lost. Some philosophers of religion have argued that moral anti-theodicy begs the question. This paper evaluates the arguments from two such philosophers, writing a decade apart—Robert Mark Simpson, and Lauri Snellman. Simpson argues that any global argument against theodicy must allow for the possibility of there existing a plausible theodicy, and that anti-theodical arguments (the argument from insensitivity, the argument from detachment, and the argument from harmful consequences) all implicitly discount this possibility, thus ending up begging the question. Snellman argues that (...) moral anti-theodicies presuppose that some evils cannot be justified, which would presuppose that theodicy is false from the start, which in turn would beg the question against theodicy. The author of the paper argues that Simpson’s arguments rest on an erroneous assumption regarding the nature of anti-theodicy, and that one of Simpson’s arguments sets a problematic standard for argumentation that the author argues we should not accept. It is also argued that Snellman’s argument relies on an unsupported claim from Toby Betenson. Therefore, the author concludes that Simpson and Snellman have not managed to show that moral anti-theodicies beg the question. (shrink)

Several philosophers have argued recently that semantic properties do play a causal role. 1 It is our view that none of these arguments are satisfactory. Our aim is to reveal some of the deficiencies of these arguments, and to reassess the question in our own way. In section 1, we shall explain in more detail what is involved in the pretheoretical idea of a causally efficacious property and so provide a fuller sense of the issue. In section 2 we shall (...) discuss Fodor's and Kim's arguments that the semantic properties of mental events are causally efficacious. Their tactic is to articulate sufficient conditions for the causal efficacy of a property, and then apply these conditions to the psychological properties under consideration. We shall show that both formulations are inadequate. However, each account can remedy some of the defects of the other. We shall argue that by putting the two together, and modifying this combined account in certain ways, we can arrive at something that might just pass as a general sufficient condition for causal efficacy. We believe that the question of causal efficacy of content is best approached as a question in the philosophy of science. If one wants to know whether a given species of property is efficacious, the most productive strategy is to find a science that investigates the properties and examine the role they are assigned. In keeping with this attitude we shall restrict our discussion to the notion of content deployed within cognitive science. In section 3 we examine the role of content in cognitive science and discuss whether this role suits content to the conditions on efficacy articulated in section two. Our conclusion will be conditional and hedged: on certain views of cognitive science, content will meet the sufficient condition for efficacy. If other views are correct, the question remains open. In international law and the ethics of war, there are a variety of actions which are seen as particularly problematic and presumed to be always or inherently wrong, or in need of some overwhelmingly strong justification to override the presumption against them. One of these actions is assassination, in particular, assassination of heads of state. In this essay I argue that the presumption against assassination is incorrect. In particular, I argue that if in a given scenario war is justified, then (...) assassination of the enemy state's leader is also justified, and in fact ought to be pursued as a means short of war. I defend this position on both consequential and deontic grounds, arguing that assassination is both more discriminate than war and serves to harm only those most responsible for the situation which justifies war in the first place. I conclude by arguing that a norm of assassination, far from being a destabilizing force, as some have argued, would in fact serve to reinforce international norms of rights and respect for persons by making clear that tyrants and would-be oppressors cannot hide behind military forces or notions of sovereignty to protect themselves from judgment and retribution. In this paper, I first explore Hegel’s own distinctions between various types of idealism, most of which he explicitly rejects. I discuss his notions of subjective, transcendental and absolute idealism and present the outlines of his criticisms of the first two as well as the motivation behind his commitment to a version of absolute idealism. In particular, I argue that the latter does not share the defining features of what is now commonly called ‘idealism’, as Hegel neither denies the existence (...) of an external world nor even holds that we can only somehow indirectly infer the truth of propositions about the external world from the structure of some given mental material. I give a basic account of what Hegel’s concept of ‘the absolute idea’ is about, which lies behind his absolute idealism. In this context, I maintain that it is crucial for our understanding of Hegel and of his potential relevance for contemporary metaphysics and epistemology that the absolute idea is precisely not a mental or ‘spiritual’ (geistig) entity. Rather, it amounts to a set of methodological assumptions designed to guarantee the overall intelligibility of what there is, regardless of its actual natural, social or more broadly normative structure. Artificial intelligence (AI) has become nearly ubiquitous in modern society, from components of mobile applications to medical support systems, and everything in between. In societally impactful systems imbued with AI, there has been increasing concern related to opaque AI, that is, artificial intelligence where it is unclear how or why certain decisions are reached. This has led to a recent boom in research on “explainable AI” (XAI), or approaches to making AI more explainable and understandable to human users. In the (...) military domain, numerous bodies have argued that autonomous and AI-enabled weapon systems ought not incorporate unexplainable AI, with the International Committee of the Red Cross and the United States Department of Defense both explicitly including explainability as a relevant factor in the development and use of such systems. In this article, I present a cautiously critical assessment of this view, arguing that explainability will be irrelevant for many current and near-future autonomous systems in the military (which do not incorporate any AI), that it will be trivially incorporated into most military systems which do possess AI (as these generally possess simpler AI systems), and that for those systems with genuinely opaque AI, explainability will prove to be of more limited value than one might imagine. In particular, I argue that explainability, while indeed a virtue in design, is a virtue aimed primarily at designers and troubleshooters of AI-enabled systems, but is far less relevant for users and handlers actually deploying these systems. I further argue that human–machine teaming is a far more important element of responsibly using AI for military purposes, adding that explainability may undermine efforts to improve human–machine teamings by creating a prima facie sense that the AI, due to its explainability, may be utilized with little (or less) potential for mistakes. I conclude by clarifying that the arguments are not against XAI in the military, but are instead intended as a caution against over-inflating the value of XAI in this domain, or ignoring the limitations and potential pitfalls of this approach. Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

In recent years, it has been acknowledged increasingly that the relationship between analytic and continental philosophy is one of complementarity rather than opposition, as previously often assumed. In this essay I will argue that, in fact, early analytic philosophy has its roots in the tradition of continental philosophy. The essay will focus on Hermann Lotze's influence on Frege and on Frege's relationship to the Neo‐Kantians Otto Liebmann and Wilhelm Windelband. It will provide new evidence for the claim that Frege's philosophy (...) should be seen as belonging to the tradition of Neo‐Kantianism and, along the way, exhibit the continental roots of Frege's context principle. The article considers the philosophical potential of Heraclitean ambiguity and implications for how one might engage philosophically with Heraclitus. While works on Heraclitus most commonly offer new interpretations or dispute or add nuance to established interpretations, this work somewhat sidesteps interpretive disputes to consider the philosophical value and relevance of Heraclitus’s fragments themselves. Specifically, a hermeneutical tool proposed by William Desmond called a “companioning approach,” is supported. Desmond’s companioning approach is considered in the context of Pierre Hadot’s account of the (...) history of hermeneutical practices to show that it merely defines and legitimizes a longstanding hermeneutical activity. Further, a recent work by A. V. Halapsis shows that Heraclitus’s ambiguity may have been a consequence of his anthropological commitments and that he may have intended to allow for something like a companioning engagement. As we have discussed elsewhere, Franz Boas and John Dewey were intellectual and political allies at Columbia University for over thirty years.1 Dewey advocated for an increased role of anthropology for philosophical insight, and he often used anthropological knowledge as a starting point for his ethics and politics, including such knowledge as learned from Boas. We hold that Boas and Dewey shared a common core understanding of human global and evolutionary diversity, and that this shared understanding itself forms a core (...) component of their progressive projects.However, with regard to the problem of racism in the United States, Boas and Dewey had different engagements. RESUMEN Fundamentación: la intervención de los anestesiólogos durante el preoperatorio de los pacientes con fractura del tercio proximal del fémur no queda reducida a la recopilación de datos científicos de carácter biológico, es una exigencia actual enfrentarse al paciente con una profunda comprensión de su esencia social y desde una posición humanista. Objetivo: determinar las condiciones sociales del sufrimiento de los pacientes con fractura del tercio proximal del fémur durante el preoperatorio. Método: se realizó un estudio de revisión sistemática cualitativa, (...) con la información cualitativa descriptiva a través de la recolección, evaluación, verificación y síntesis de las evidencias existentes. Resultados: si está indicada la intervención quirúrgica, se asegura la prevención de la discapacidad en la población envejecida vulnerable o frágil con alto riesgo quirúrgico. La fragilidad como proceso dinámico produce la transición a mayor fragilidad y su vez conduce a un espiral de resultados adversos de salud con carácter multidimensional y progresivo. Discusión: la ética del cuidado destaca la importancia de valorar el sufrimiento del paciente, la necesidad y sensibilidad para responder de tal forma que se proteja al paciente y sus familiares de la sensación de aislamiento, abandono y discapacidad propios de la enfermedad. El cuidado es una actividad permanente y cotidiana de la vida de las personas, el cuidado por parte de los anestesiólogos incluye profesionalidad a lo cotidiano. ABSTRACT Background: the intervention of the anesthesiologists during the preoperatory of the patients with fracture of the third proximal of the femur is not reduced to the summary of scientific data of biological character; it is a current demand to face the patient with a deep understanding of its social essence and from a humanist position. Objective: to determine the social conditions of the suffering of the patients with fracture of the third proximal of the femur during the preoperatory. Method: it was carried out a study of qualitative systematic revision, with the descriptive qualitative information through the gathering, evaluation, verification and synthesis of the existent evidences. Results: if it is suitable the surgical intervention.The fragility like dynamic process produces the transition to more fragility and its time it drives to a hairspring ofadverse resultsof health with multidimensional character and progressive. Discusión: the ethics of the care highlights the importance of valuing the patient's suffering, the necessity and sensibility to respond in such a way that is protected to the patient and its relatives of the isolation sensation, abandonment of the illness. La formación profesional tiene un carácter contextualizado que responde a las exigencias que la época, la sociedad y el país reclaman a las universidades. La Estomatología en Cuba no se encuentra al margen de estos preceptos por lo que desarrolla un plan de estudio que acentúa la flexibilidad para realizar modificaciones necesarias y pertinentes. El estudiante al culminar la carrera debe brindar una atención estomatológica integral donde las anomalías dentomaxilofaciales constituyen la tercera línea de trabajo. Estas ocasionan afectaciones estéticas que (...) repercuten en la autoestima y adaptación social de niños y adolescentes por lo que se necesita de una orientación sicoeducativa, acción para la cual el profesional deberá estar preparado. A partir de las insuficiencias detectadas en el proceso formativo del estomatólogo, el objetivo del presente trabajo es proponer un curso propio sobre la temática para favorecer la graduación de un profesional capaz de resolver los problemas que afectan el complejo estomatognático con un enfoque biosicosocial. Los métodos empleados fueron el histórico-lógico y análisis-síntesis. Professional training has a contextualized nature which reflects the demands that the time, society and the country require from universities. In Cuba, Stomatology is not out of these precepts and therefore it carries out a syllabus that emphasizes flexibility to make necessary and appropriate changes. When students graduate, they must provide a complete stomatological care where dental maxillofacial anomalies are the third line of work. They cause aesthetic harm that affects children and teenagers' self-esteem and social adaptation which makes psych educational guidance necessary; a situation professional must be prepared for. Starting from the weak points discovered in the training process of stomatologists, a crash course in the subject is suggested in order to favor the graduation of professionals who are able to solve problems that affect the stomatognatic complex with a biopsychosocial approach, through the use of required methods, techniques and procedures. Studying evidence law as part of naturalized epistemology means using the tools and results of the sciences to evaluate evidence rules based on the accuracy of the verdicts they are likely to produce. In this chapter, we introduce the approach and address skeptical concerns about the value of systematic empirical research for evidence scholarship, focusing, in particular, on worries about the external validity of jury simulation studies. Finally, turning to applications, we consider possible reforms regarding eyewitness identifications and character evidence.

O presente texto tem por objetivo compreender a pintura de Wassily Kandinsky a partir da metafísica do belo de Arthur Schopenhauer, especialmente a partir da relação entre pintura e música estabelecida pelo pintor.

In this paper I investigate affinities between Nietzsche’s early philosophy and some aspects of Kant’s moral theory. In so doing, I develop further my reading of Nietzschean wholeness as an ideal that consists in the achievement of cultural—not psychic—integration by pursuing the ennoblement of humanity in oneself and in all. This cultural achievement is equivalent to the procreation of the genius or the perfection of nature. For Nietzsche, the process by means of which we come to realize the genius in (...) ourselves is one in which our true content comes to necessarily govern or guide the shaping of our outer form (or our outward activities). Since this true content turns out to be our autonomy or free agency, I argue that this Nietzschean idea of necessitation parallels in important ways Kant’s notion of normative necessity. In particular, I claim that for Nietzsche the agent’s form becomes necessitated by his content as a result of the agent’s recognition of the duties that befall those who aspire to belong to a genuine culture and his resolve to guide his actions in accordance to them. These duties spring from the idea of humanity, from the image we have of ourselves as endowed with the capacity to be the helmsmen of our lives or to be more than mere animals or automata. The person who takes up this ideal of humanity turns his life into a living unity of content and form by organizing it around an aspect of his being that belongs necessarily, hence more truthfully, to him. He also participates in a collective project (that of the ennoblement of the human being) that can lend a certain coherence and imperishability to his individual life and through which he becomes necessarily connected to everyone else for all eternity. During the last few decades, the historical turn within the tradition of the analytic tradition has experienced growing enthusiasm concerning the procedure of rational reconstruction, whose validity or importance, despite its paradigmatic examples in Frege and Russell, has not always enjoyed a consensus. Among the analytic philosophers who are the frontrunners of this movement, Robert Brandom is one of a kind: his work on Hegel as well as on German Idealism has been increasing interest in, as well as awareness of, (...) Hegel´s possible contributions to some current problems in that tradition, and connecting Hegel scholars to current questions. Thus, this work aims to explore Brandom´s methodology of rational reconstruction, as well as his dialogue with history of Philosophy, mainly exposed in his Tales of the mighty dead (2002). As we will see, Brandom´s distinction between a de dicto and a de re approach intends to present a way of identifying and analyzing a given philosopher´s theoretical (hidden) commitments that can be useful to improve the quality of the dialogue with past philosophers. From such methodological exposition, I to turn to Kierkegaard in order to make explicit some of his ontological commitments and presenting Brandom’s approach as a valuable tool for doing history of philosophy. La lectura que aquí se presenta quiere recoger los elementos que aparecen en la estructura formal compleja del _Eutidemo_ y comprender las razones autoriales para esa disposición. Para ello, analiza la parte final del diálogo y la vincula a la narración del encuentro de Sócrates con los hermanos. El juicio negativo del interlocutor final de Critón se revela así como una de las posibles impresiones que deja el diálogo socrático. Por su parte, la crítica ejercida inmediatamente sobre ese interlocutor permite (...) al autor descartar esa lectura del diálogo, planteando así la cuestión de cómo interpretarlo correctamente. La tesis que aquí se esboza es la de que el diálogo debe leerse en clave protréptica, pero no solo por las partes explícitamente protrépticas de Sócrates y Clinias, sino en todos sus niveles de interacción, incluyendo la complejidad formal en que el diálogo se dispone. En este artículo se plantean los problemas de la unidad y de la especificidad de la filosofía y de su facultad, en el marco de la universidad y en relación con la sociedad. Todo ello al hilo del análisis de los aspectos más destacados de aquella noción que Michel Foucault reservó para indicar la característica diferencial de la actividad del pensamiento: la noción de “problématisation”. En el marco de nuestras consideraciones presentaremos la facultad de filosofía como la facultad de una (...) universidad libre y pública, como una facultad no entregada a “conocer”, “crear” o “actuar”, sino a un pensar -cuya especificidad es problematizar- capaz de vertebrar la imprescindible función crítica que la universidad ha de tener en nuestra sociedad, bajo una autonomía, libre de las demandas sociales, que, por lo mismo, pueda proponer modelos de orientación para una mayor libertad e igual social. This paper focuses on the consolidation of Molecular Evolution, a field originating in the 1960s at the interface of molecular biology, biochemistry, evolutionary biology, biophysics and studies on the origin of life and exobiology. The claim is made that Molecular Evolution became a discipline by integrating different sorts of scientific traditions: experimental, theoretical and comparative. The author critically incorporates Timothy Lenoir’s treatment of disciplines , as well as ideas developed by Stephen Toulmin on the same subject. On their account disciplines (...) are spaces where the social and epistemic dimensions of science are deeply and complexly interwoven. However, a more detailed account of discipline formation and the dynamics of an emerging disciplinary field is lacking in their analysis. The present essay suggests focusing on the role of scientific concepts in the double configuration of disciplines: the social/political and the epistemic order. In the case of Molecular Evolution the concepts of molecular clock and informational molecules played a central role, both in differentiating molecular from classical evolutionists, and in promoting communication between the different sorts of traditions integrated in Molecular Evolution. The paper finishes with a reflection on the historicity of disciplines, and the historicity of our concepts of disciplines. (shrink)

El Estado de Hegel es el Estado de Derecho. Sin embargo en su Filosofía del Derecho se encuentran fundamentos decisivos para una teoría del Estado Social. Siguiendo el hilo de las Líneas fundamentales de la Filosofía del Derecho, se empieza por ver el derecho al bienestar, tal como se formula en la Moralidad (1). En la familia aparece el derecho de los hijos "de ser alimentados y educados" (2). El Derecho al bienestar se concreta en la sociedad civil (3), se (...) hace posible en el sistema de las necesidades (3.1.) y efectivo en la policía y la corporación (3.2 y 3.3), que ejercen funciones de suplencia de la familia. El mayor problema es la pobreza, tanto la que surge por contingencias subjetivas y sociales como por el funcionamiento mismo de la sociedad civil: la plebe. A este problema la sociedad es incapaz de darle una solución. (shrink)

Este artículo1 explora dos obras cinematográficas guatemaltecas, Polvo (2012) y Nuestras madres (2019), dirigidas por Julio Hernández Cordón y César Díaz correspondientemente. En ambos largometrajes la denuncia sobre la violación de derechos humanos durante el pasado conflicto armado guatemalteco, la búsqueda de padres o familiares desaparecidos y sus secuelas en las víctimas constituyen la temática central. Por tanto, el análisis se centra en la importancia que tiene la búsqueda del padre desaparecido en los hijos, quienes, a raíz de esta (...) vivencia traumática, experimentan un vacío identitario, así como estragos individuales provocados por la falta de la figura paterna. Por otro lado, también se analizan el trauma y el silencio de las madres sobrevivientes como remanente del miedo/terror experimentado durante el conflicto armado, pero también como un mecanismo de protección para sus hijos. En especial, el análisis se auxilia teóricamente con el extenso trabajo realizado por el sociólogo uruguayo Gabriel Gatti sobre la desaparición forzada. 1 Este ensayo forma parte de una serie de proyectos de investigación y se realizó con el apoyo de la beca Volgenau de la Academia Naval de Estados Unidos. Este artículo es una aproximación crítica e integradora de los procesos de subjetivación política en los trabajos de Antonio Gramsci, Michel Foucault, Raymond Williams y Stuart Hall. Para ello, se explicará, en primer lugar, el giro epistémico realizado por Michel Foucault a finales de 1970 que le conduce a buscar la estética de la existencia tras teorizar la relación de poder y libertad. Posteriormente se analizará qué entienden por subjetivación política estos autores. El análisis de la transformación teórica que lleva (...) a cabo Michel Foucault de la relación entre poder y libertad a partir de obras como El nacimiento de la biopolítica, El uso de los placeres o La hermenéutica del sujeto permitirá precisar el análisis comparativo entre hegemonía, cuidado de sí y contrahegemonía en los autores señalados. Por último, presentaremos la especificidad de la relación entre los trabajos de Gramsci y Foucault con Williams y Hall como mediadores epistemológicos. (shrink)

El presente trabajo parte del planteamiento del enfoque radical e inclusivo en el que, entre otros aspectos, se señala que hay determinados temas, denominados radicales, que no son socialmente demandados, pese a que su inclusión en educación es clave para la formación. Este es el caso del “amor”, un tema que no se suele tener en cuenta, aunque se puede intuir su impacto significativo en nuestra educación. Desde este enfoque, se entiende el amor como opuesto al egocentrismo, y considera la (...) importancia de incluir estos temas como forma de alcanzar una educación plena. Por ello, nuestro trabajo se centra en comprobar la presencia de este tema radical (el amor) en la legislación educativa vigente en España. El estudio se realiza a través de una metodología de análisis documental, considerando la normativa referente al desarrollo curricular de la Ley Orgánica 3/2020 (LOMLOE), así como sus concreciones a nivel autonómico, utilizando como unidades de análisis la palabra amor y derivadas. El análisis se realiza a través de técnicas cuantitativas, registrando la frecuencia de la presencia del concepto en los Reales Decretos por los que se establecen la ordenación y las enseñanzas mínimas, así como en los documentos derivados del desarrollo posterior que realizan de estas normas las comunidades autónomas en las diferentes etapas educativas (Infantil, Primaria, Secundaria Obligatoria y Bachillerato), asimismo se atendió a los ámbitos de conocimiento donde está este término presente. Los resultados obtenidos indican que el marco normativo curricular estatal y autonómico apenas incluye el concepto amor. Por este motivo, este estudio detecta que los temas relacionados con el amor no son prioritarios en los documentos analizados, por lo que se plantea la necesidad de que desde el ámbito educativo se incluya en los currículos, de las diferentes etapas educativas, el tema del amor que es primordial para la formación.
